Terms of service
Sipero Online provides World Wide Web page hosting. Sipero Online
reserves the right to suspend or cancel a customer's access to any
or all services provided by Sipero Online when Sipero Online decides
that the account has breached the Terms of Service.
Definitions
"Charges" means the charges payable by the Customer for
the provision of the Services details of which can be found on the
Company's Website through http://www.siperoonline.co.uk, http://www.siperoonline.com,
http://www.sipero.co.uk, http://www.sipero.com, which may vary from
time to time;
"Company" means Sipero.com, whose office is currently
situated at 12 Wellfield Gardens, Carshalton, Surrey, United Kingdom SM5
4EA;
"Commencement Date" means the date upon which the Company
confirms acceptance of the Customer's offer to pay for the Services
in accordance with these Conditions;
"Credit/Debit Card" means any credit card or debit card
issued by financial institutions which is acceptable to the Company
and include but are not limited to Master Card, Switch Card, Delta
Card and Visa Card.
"Order" means a request made by the Customer to the Company
for Services to be supplied subject to these Conditions;
"Specified Service" means the Service ordered by the
Customer.
Use of services
By accepting these terms and conditions you are agreeing that you
have the neccessary ability and knowledge to make use of the services
offered by Sipero Online. Sipero Online provides detailed help and
instructions to assist in the use of these services. E-mail technical
support is made available to all users requiring assistance at all
levels, however Sipero Online restrict this support to advice and
information only and will not under any circumstances:
- Assist in the development or design of content
- Transfer files or folders
- Optimize site content
WHERE the customer / client has the ability to do so, unless such
services have been agreed by Sipero Online.
SERVER USE
Sipero Online reserves the right to refuse service and /or access
to its servers to anyone.
Sipero Online do not allow any of the following content to be stored
on its servers:
Illegal Material - In any form, including but not limited to the
unauthorised distribution or copying of copyrighted software or
other data, harassment, fraud, trafficking in obscene material.
Undesirable Content - We do not host adult content of any description.
Content relating to Hacking, Cracking, Warez and IRC is not allowed.
Software downloads may only be hosted if you are the writer and
copyright owner of the software, all other software including freeware,
shareware and trial software is forbidden. Audio and video downloads
may only be hosted if you are the creator and copyright owner of
the work.
Unlinked material: Files of any type which are not linked to from
your web site hosted on Sipero Online servers may be removed without
warning to avoid the use of file storage on our servers.
Warez - Includes pirated software, ROMS, emulators, phreaking,
hacking, password cracking. IP spoofing, etc., and encrypting of
any of the above. Also includes any sites which provide "links
to" or "how to" information about such material.
BANDWIDTH AND SERVER USAGE POLICY
In rare cases Sipero Online may find a customer to be using server
resources to such an extent that he or she may jeopardize server
performance and resources for other customers. In such instances,
Sipero Online reserves the right to impose the High Resource User
Policy for the consideration of all customers.
HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilization.
Sipero Online may implement the following policy to its sole discretion:
When a website is found to be monopolising the resources available
Sipero Online reserves the right to suspend that site immediately.
In the event of an account exceeding its allocated bandwidth the
user is liable for the cost of excess bandwidth at the rate of £1.80
+ VAT per 100mb or part thereof. With the exception of the Brone
hosting packages all users have access to adequate statistics and
information detailing their account bandwidth useage and predicted
monthly usage in order to forsee any excessive use. In all cases
the user will be notified by email of any forseeable excessive use
of bandwidth. This policy is only implemented in extreme circumstances
and is intended to prevent the misuse of our servers. Customers
may be offered an option whereby Sipero Online continues hosting
the website for an additional fee.
PAYMENT POLICIES
All accounts are set up on a prepay basis. Although Sipero Online
reserves the right to change prices of accounts or services at any
time all pricing is guaranteed for the period of prepayment. Payment
is due each anniversary year or month following the date the account
was established, depending on the chosen payment frequency. Customers
will automatically be charged again at the end of their prepay period
unless closure notification has already been given by either Sipero
Online or the customer.
In situations where the card number on file is declined Sipero Online
will immediately suspend the facility to purchase services on-line
until the outstanding charge is processed successfully. In addition,
Sipero Online reserves the right to suspend other services until
the outstanding debt is cleared. The customer is responsible for
all money owed on the account from the time it was established to
the time that the customer sends a written cancellation request.
Where other charges are incurred, for additional products, or excess
usage fees as detailed in the High Resource User Policy, payment
may be debited from the registered credit or debit card up to 60
days after the charge is incurred. In all cases notice of charges
or excess fees will be issued no less than 24 hours prior to the
card being debited.
All accounts are payable on demand. In the absence of demand, payment
in full for the goods supplied shall be made by the Buyer to the
Seller on or before the fourteenth day following the date of the
invoice. The Seller shall also be entitled to charge such reasonable
costs as it may incur in recovering any overdue balances.
If the Charges are not paid in accordance with the Company's invoice,
the Company shall be entitled so far as is permitted by law and
without prejudice to any other rights it may have to charge interest
on the outstanding amount (both before and after judgement) at the
rate of 6% above the base rate from time to time of LloydsTSB bank
PLC from and including the due date but excluding the date the outstanding
amount is paid in full.
No bills or invoices will be sent by regular mail. All invoices
will be sent directly to customers via email shortly after the online
purchase has been made. At this point the customer's card will be
charged automatically.
PAYMENT OPTIONS
In order to streamline our accounting procedures and keep costs
down Sipero Online runs a limited number of payment options.
Credit / Debit Cards:
Sipero Online accepts Mastercard, Visa (not Visa electron), Switch
and Solo
Cheque Payment:
This option is only available in some cases on request of a Sipero
Online account. A credit / debit card number will still be required
if customers require the facility to purchase domains and other
services on-line. Sipero Online cannot guarantee that a service
will be provided until after any received cheques have been cleared.

You agree that Sipero Online is not obliged to offer telephone
support as part of your agreement unless otherwise stated.
CANCELLATION AND REFUNDS
Sipero Online reserves the right to cancel the service at any time.
In this event customers will be entitled to a pro rata refund based
upon the remaining period of membership. If a customer contravenes
Sipero Online's Terms of Service a refund will not be issued in
the event of a cancellation.
If not entirely happy with the service provided by Sipero Online,
customers may cancel their order within 7 days from order date without
reason. Any payment made will be returned within 30 days of cancellation.
Any incentives offered to customers when opening the account will
also be cancelled - Where a free domain name is offered as part
of a package the domain name remains the property of the account
holder and will be charged at the standard rate which will be deducted
from any monies owed by Sipero Online. Any domain name controlled
by Sipero Online may be transferred to the new host free of charge
at the request of the domain owner.
Customers paying anually may cancel their account at any time.
Any domain name controlled by Sipero Online may be transferred to
an alternative host free of charge at the request of the domain
owner.
Customers paying monthly may cancel their account at any time by
paying in full the remaining cost of their 12 months subscription.
Any incentives offered to customers when opening the account will
also be cancelled - Where a free domain name is offered as part
of a package the domain name remains the property of the account
holder and will be charged at the standard rate. In the event of
cancellation by the customer of a monthly paid account, all remaining
fees onwed by the customer are due within 14 days. Failure to pay
within this time may result in the customers details being referred
to a registered credit reference agency and collection agency.
Customers may be given the option to purchase services which were
offered as start-up incentives in the result of a cancellation.
Where a customer is unable to make use of Sipero Online services
due to insufficient knowledge the customer should seek technical
advice from the customer support team. Refunds will not be given
in these instances when the account has been open for more than
7 days.
Fees charged on a prepay basis are non-refundable. Customers are
not entitled to receive a refund unless the service is cancelled
by Sipero Online or in circumstances where Sipero Online are in
breach a refund may be due.
INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold
Sipero Online harmless from any and all demands, liabilities, losses,
costs and claims, including reasonable attorney's fees asserted
against Sipero Online, its agents, its customers, officers and employees,
that may arise or result from any service provided or performed
or agreed to be performed or any product sold by customer, its agents,
employees or assigns. Customer agrees to defend, indemnify and hold
harmless Sipero Online against liabilities arising out of; (1) any
injury to person or property caused by any products sold or otherwise
distributed in connection with Sipero Online's server; (2) any material
supplied by customer infringing or allegedly infringing on the proprietary
rights of a third party; (3) copyright infringement and (4) any
defective products sold to customer from Sipero Online's server.
DISCLAIMER
Sipero Online reserves the right to revise its policies at any
time.
In conjunction with The Supply of Goods and Services Act 1982 Sipero
Online will carry out his work with reasonable care and skill. If
the service is not carried with the requisite level of care and
skill, the customer would be entitled to seek reimbursement for
damages suffered as a result of this.
STATUTORY RIGHTS
This does not affect your statutory rights as a consumer. |
